If the scaffold stands entirely on your land, your neighbour has no right to stop it going up. If it needs to rest on or overhang their property, you will need their consent first, and we recommend getting that in writing before the erection date. If a neighbour refuses access for essential repairs, the Access to Neighbouring Land Act 1992 lets you apply to court for an access order. During our site survey, anywhere in Hertfordshire or North London, we can show your neighbour exactly where the scaffold will sit.
Scaffolding does not invalidate a policy by itself, but many insurers expect to be told about it, because it gives easier access to upper windows. If you haven't declared it and there's a break-in while it's up, a claim could be reduced or refused. Call your insurer before your scaffolding goes up and ask whether any extra conditions apply, such as keeping upper windows locked.
Scaffolding within your property boundary does not need a permit or planning permission. If any part of it sits on the pavement or road, you need a licence from the local highway authority. In Hertfordshire that's the county council, and in London it's the individual borough. Applying for the licence is the scaffolding company's responsibility, so we arrange it for you and build the council's processing time into your start date.
In residential areas, generally not. Most councils restrict noisy building work, including erecting and dismantling scaffolding, to weekdays and Saturday mornings. The law doesn't name scaffolding specifically, but the Work at Height Regulations 2005 require anyone working on your roof to take suitable measures to prevent falls. Falls from roofs cause a large share of serious injuries in construction, and a properly built scaffold also protects the people and property below.
Only competent scaffolders authorised by the scaffold contractor should alter a scaffold. Removing a tie, board or guardrail, even for a few minutes, can make the whole structure unsafe for everyone using it. If your builder needs a lift raised or access changed, call us and we will send a team to make the alteration and check the scaffold before handing it back.
